Algemene voorwaarden

Article 1: Personal membership
1.1. Membership is entered into for an indefinite period of time and comes into effect after signing the registration form.
1.2 Membership only relates to the activities listed and the duration and price indicated.
1.3 Membership is strictly personal and non-transferable.
1.4 If you become a member during the current month, a broken monthly amount will be charged pro rata, so that the membership will start on the first of the following month. Personal Training Subscriptions start on the first day of the month.
1.5 The minimum age to take out a subscription independently is 18 years.
1.6 Subscriptions for Personal Training 1 to 2-4 must take place with a minimum of 2 people. If one of the two people is unable to attend, the appointment must be moved. If the member still wants to train, a separate 1 on 1 Personal Training can be purchased.
1.7 Should the member be for any reason, a personal training must be agreed to come, this must be reported early, but in any case no later than 24 hours in advance. Cancellations made less than 24 hours in advance will be charged.

Article 2: Contribution
2.1 The payment of the membership is repaid monthly by SEPA direct debit. The contribution due is collected monthly at the beginning of the month.
2.2 If it is not possible to collect as described in Article 2.1, we are entitled to refuse the member access to Gympact. However, this does not release the member from the payment obligation.

2.3 If an invoice is required for administration, or reimbursement at your employer, you can download the invoices in our app.
2.4 When registering, the member receives an invitation to make use of our app. The registration fee is a one-off payment of € 30.00 and will be collected automatically.

Article 3: Opening hours & Rates
3.1 Gympact is at all times entitled to change the opening hours, timetables and rates. During public holidays, Gympact reserves the right to close the club, without this resulting in a reduction of membership fees or any refund.
3.2 Gympact can change its prices according to the consumer price index from the Central Bureau of Statistics. These price changes may be implemented once a year and will be transmitted a month in advance.
3.3 Students are eligible for a €10.00 discount on their annual membership upon presenting valid proof of student registration. This proof must be submitted either at the front desk or via email. The discount is valid for a period of 12 months and will automatically expire after this period. To continue receiving the student discount, new proof of registration must be provided annually.

Article 4: Pause of membership
4.1 If the member is not able to use the facilities at all due to an injury or illness for more than one month, it is possible (only on presentation of a medical certificate from a doctor) to temporarily suspend the membership. Membership can be paused for up to 3 months. Intermission is only possible on the basis of whole calendar months as of the next calendar month. The membership end date is automatically extended by the same period as the duration of the pause period.

Article 5: Cancellation
5.1 Membership can only be canceled in writing (via a cancellation form or by e-mail). The notice period is one full calendar month.
5.2 Cancellation must be made by the member himself or by his legal representative.

Article 6: Risk and liability
6.1 Gympact is not liable for damage or injury suffered by the member. All activities developed by the member in Gympact are at your own risk. Nor is Gympact liable for damage caused by loss or theft of items in its buildings.
6.2 Insofar as the liability excluded in the previous paragraph is not accepted by the court, the possible liability of Gympact is limited to the maximum payment for which it has insured its liability, namely to the amount that its insurer pays in respect of this liability.

Article 7: House rules
7.1 The member must adhere to the following house rules:
Check in with the drop upon entry.
Follow the instructions of Gympact employees at all times.
Store personal belongings in the designated lockers in the locker room.
The use of a towel is mandatory.
The use of a mobile phone in the gym is not allowed.
Inappropriate behavior such as harassment, screaming or unnecessarily loud moaning will not be tolerated.
Always ensure that exercises do not endanger yourself and other members.
Clean equipment and return all materials to designated locations after use.
Leave the changing rooms and the gym tidy, eating in the hall is not allowed.
Personal Training must be canceled at least 24 hours in advance.
7.2 If the member does not comply with the house rules, we are authorized to immediately terminate the membership and to deny the user access to Gympact.
